1. Acceptance of Terms
By accessing, registering or using the XFlowSuite.com platform (hereinafter, the “Platform”), the user (hereinafter, the “User”) acknowledges having read, understood and agreed to be bound by these Terms and Conditions of Service (hereinafter, the “Terms”).
The User declares and warrants that:
- They are at least 18 years of age
- They have sufficient legal capacity to contract
- They act on their own behalf or on behalf of a duly authorized entity
If the User does not accept these Terms, they must refrain from using the Platform.

Nature of the Service
XFlowSuite.com provides a technological solution under the Software as a Service (SaaS) model, which may include, among other functionalities:
- CRM (Customer Relationship Management)
- Marketing and sales automation
- Funnel and website creation
- Communication tools (email, SMS, messaging, etc.)
- Third-party service integrations
- Artificial Intelligence-based functionalities
The Company acts exclusively as a technology infrastructure provider, without intervening in the User’s commercial activities.
License of Use
The User is granted a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to use the Platform. The User agrees not to:
- Copy, modify or distribute the Platform
- Reverse engineer or attempt to access the source code
- Use the Platform for unlawful purposes
Acceptable Use
The User must use the Platform in accordance with applicable law. The following are prohibited:
- Sending spam or unsolicited communications
- Fraudulent or deceptive activities
- Use for illegal content
- Infringement of third-party rights
- Introduction of malware
The Company may suspend the service in case of violations.
Account and Security
The User is responsible for:
- The confidentiality of their credentials
- All activity carried out from their account
- Implementing adequate security measures
Third-Party Relationships
- The User is solely responsible for their clients, communications and operations.
- The Company assumes no responsibility for such relationships.
Regulatory Compliance
The User agrees to comply with all applicable regulations, including data protection, communications and tax obligations.
Personal Data
The User is responsible for:
- Obtaining necessary consents
- Having their own privacy policies
The Company will act as data processor.
Artificial Intelligence
- AI functionalities may generate inaccurate or incomplete results.
- They do not constitute professional advice.
- The User is responsible for validating any results.
Third-Party Services
The Platform may integrate with external services. The Company:
- Does not control such services
- Does not guarantee their availability
- Does not guarantee permanent compatibility
Fees and Payments
- Subscription-based services
- Automatic renewal
- Non-refundable payments (except as required by applicable law)
The User may cancel at any time from their account.
Termination and Data
The Company may suspend or cancel the service due to:
- Breach
- Non-payment
- Security risks
Data may be deleted after a reasonable period following termination.
White Label and Resale
Users who resell the Platform:
- Act as independent providers
- Do not represent the Company
- Are responsible for support and legal compliance
Intellectual Property
All rights to the Platform belong to the Company.
Limitation of Liability
- The Platform is provided “as is”.
- The Company does not guarantee commercial results.
- Total liability shall not exceed the amount paid in the last 3 months.
Indemnification
The User shall indemnify the Company against claims arising from:
- Misuse
- Breach
- Violation of third-party rights
Service Availability
The Company does not guarantee uninterrupted availability, although it will make reasonable efforts to maintain the service.
Modifications
The Company may modify these Terms at any time.
Governing Law
- These Terms are governed by the laws of the State of Delaware.
- Disputes shall be resolved through binding arbitration.
- The User waives class actions.
